This is a goofy lawsuit on its face except for one element that I will comment on in a moment.

Nikolai Grushevski, a man from Corpus Christi, has filed a lawsuit because Hooters wouldn’t let him work as a waiter, which we guess would be called a Hooters Boy.

“Hooters tries to circumvent the law by referring to its waiters as ‘Hooters Girls.’ Hooters is wrong,” claims the lawsuit, filed yesterday in federal court in Corpus. “Just as Southwest Airlines attempted nearly three decades ago with stewardesses, the waiter’s position addressed herein is being limited to females by an employer ‘…who merely wishes to exploit female sexuality as a marketing tool to attract customers and insure profitability.’”

Exactly. Thankfully, the lawsuit says that Grushevski isn’t trying to stop the restaurant from hiring Hooters Girls.

OK, on the face of the lawsuit, the guy suing is actually correct.  It is a practice that sexually discriminates, as it applies a job that is traditionally gender neutral, a waiter/waitress, and locks it into a female only model.

But at the same time, I think the free market ought to handle this.  If you disagree with their only hiring young busty girls as waitresses, vote with your wallet.  Obviously the public outrage seems to be somewhat…err…subdued.

Except…

There is a part of me that hopes they win.  After all women have been playing this game for decades, using lawsuits and accusations of discrimination to gain access to all manner of careers.

In most cases I don’t really care.  As long as the person can do the job, let them apply.

What has always bothered me is that many times I just don’t see why they need to bust the status quo this way.  For example, the most ridiculous one was female sports reporters suing for access to male locker rooms.

I’m still waiting for the gender reversed efforts there…

And another place that bothered me was when standards had to be lowered for women to qualify for the jobs.  I think that unless the standards were artificially inflated to keep them out, that is a dangerous precedent.

This is akin to the lowering of admissions scores to qualify otherwise unqualified college applicants because of their race or gender.

And as Hooters says, they have the right to hiring whom they think and should be left alone.  Since our culture has made it clear that is not acceptable, then this lawsuit should be a no brainer.

So a part of me that thinks we have become a society that has traded common sense for litigation hopes the guys win. 

I have to note that if this was a male policy of beefcake guys at a family restaurant, likely there would be more sympathy.  But that is speculation.

Apparently this has been tried before, when Hooter’s settled out of court and agreed to allow guys to be bus boys and bartenders.

Hooters has agreed to pay $3.75 million to settle a lawsuit filed by men who were denied jobs by the restaurant chain, which is known for its voluptuous and scantily clad female bartenders and servers.

The settlement allows Hooters to continue luring customers with a female staff of Hooters Girls. But the chain also agreed to create a few other support jobs, like bartenders and hosts, that must be filled without regard to sex.

3.75 Mil…think the 7 guys are laughing to the bank?  not so much…

Three men from the Chicago area sued Hooters after being denied employment at an Orland Park, Ill., restaurant. Each of them will get $19,100. Four men who filed a similar lawsuit in Maryland will receive $10,350 each.

A stunning amount of wealth.  At least the lawyers are happy.

At any rate, this is the result of a society that stands in such a hypocritical place as to say in one breath that we are all equal, and gender neutrality is the law, while at the same time allowing gender restrictions to permeate so many places in society.

Hooters, for what it’s worth has a simple premise.  They are betting that more people who  come to their eatery would rather see this:
